The Chemours Company faces a securities class action lawsuit alleging that it misrepresented aftermarket demand for Opteon refrigerants and the reliability of its 2026 financial guidance. According to law firm Levi & Korsinsky, the case concerns approximately $65 million in Opteon aftermarket sales recorded in 2025 that management later estimated should have been allocated more to 2026.

The complaint alleges that Chemours’ Thermal & Specialized Solutions (TSS) segment experienced excess distributor inventory following increased refrigerant purchases during the US residential air-conditioning equipment transition driven by the AIM Act. Plaintiffs claim the company continued to describe aftermarket demand as strong between February 20 and August 4, 2026, without adequately disclosing the inventory buildup.

In its second-quarter 2026 results, Chemours reported net sales of $1.6 billion, approximately 1% below the previous year, and a 4% volume decline attributed primarily to lower Opteon blends aftermarket sales. The company linked the decline to elevated demand in 2025, when customers purchased refrigerants ahead of need amid supply constraints. Chemours indicated that this comparison would affect both the second and third quarters of 2026.

In May 2026, Chemours disclosed an approximately $10 million adjusted EBITDA impact from TSS demand pulled forward into the first quarter and projected second-quarter TSS adjusted EBITDA of $210 million to $225 million. Following the company’s August 4 second-quarter report and reduced full-year adjusted EBITDA guidance, Chemours shares declined by $3.34, or 18.63%.

“The complaint raises serious questions about whether investors received accurate information about how much Opteon inventory was already sitting with Chemours’ aftermarket distributors. As alleged, the channel had been stocked ahead of demand in 2025 even as the Company projected continued TSS growth into 2026,” said Joseph E. Levi, attorney at Levi & Korsinsky. Investors who purchased Chemours securities during the specified period have until December 7, 2026, to seek appointment as lead plaintiff.
